Legal Aspects... and Fishing


The US of A is considered a great country.
Now... I have great admiration for the American people.

Very smart set of people. Hardworking.
They plan, implement projects/ ideas decades in advance.

...

They have got solid rules, laws and regulations in place. For almost all aspects/
facets of governance, etc.

...

Now... this also accounts for the sole reason that the best brains around the world
have always wanted to move to the US and melt into the main-stream.

And, the Americans have been smartest enough to create the requisite infrastructure with
the finest of environs that attracts the best of minds from across the world to their
shores.

We all live in a better world courtesy the Americans, in many senses...
This remains the bare fact. Nothing can be further from the truth.

Good / better/ best choice, shall we say... ?

Be your own judge !

Herewith, let us consider a couple of hypothetical case scenarios.
Follows here...

A)

Let us look at the rules/ rights/ regulations as far as "right to drive"
or "right to be on the road" is concerned.

In case one wants to drive an automobile on the roads/ freeways in the USA.
(S)he needs to procure a Driving License ( DL ) from a competent authority.

There is a definitive process for being granted a DL...

One needs to turn up at the local District Transport Office/ Authority ( DTO ).

And... register therein.

Study the nuances of the rules, regulations, road-signs, laws, etc. pertaining to
safe driving.

Then one must appear for a test. Clear the theoretical test. Passing which
one has to schedule and appear for an auto road test. Safely passing which,
one is qualified to be granted a DL. Is granted a DL, then.

A cumbersome yet pretty orderly/ systematic process. Pretty good one.

Now, DL valid in one state NEED NOT be valid in ALL the states in the USA.
If one moves onto another state, one might need to repeat the whole process
right from scratch. And, procure a new resident DL for the new/ current state.
For, there could be some changes in rules.

Above is, but, one example of good planning, implementation, execution.
Set up all across the country by the people ( read, Govt. ) for the people.

This is, in essence, a part of good governance.

BEST rules, regulations and good laws make the foundation stone for great nations.


B)

In India, obtaining a firearm is NOT at all easy. There are several Govt.
clearances that are required and must be necessarily cleared.

To start with...
One must show the need/ necessity/ urgency for obtaining and retaining a
firearm and then apply with the District administration to procure the
arms license.

One is allowed a license after a due vetting process. One must be able to
effectively demonstrate soundness of mind and health. And be adept in
usage of the firearm. Must need demonstrate the usage ability.

Most often, the arms license is granted for one year. This needs to be
renewed on an yearly basis by the licensee.

Now...


C)

Let's assume that there was NO system in place for obtaining a DL in the USA.
One were supposed to learn the ropes on one's own. Learn driving. Drive.
And, learn the rules/ regulations/ laws for safe driving all by oneself.

Let us say, everything is there for one to - see, read, learn.

Apart from one's perception and observation...
Rules, regulations and law books are there to be bought off book-shelves.
That's it.

Of course, there always is the governing authority lurking around. Mandated
to keep up the required laws/ rules/ regulations intact - basically in an
inviolable state. These laws of the land are sacrosanct. You see.

Now, supposing this ( potentially ) disguised road transport authority decides
to be a wee bit playful.

Lets' say... they get hitherto unknown/ incognito Presidential sanction to
play around and fool with the masses...

See... they have the AUTHORITY... HAVE POWER... CAN PLAY. MUST PLAY.
Special Presidential powers vested... with the TA !! ??

FOR - WHO STOPS THEM. THEY, AFTER ALL, OWN AND MANAGE THE ROADS AND THE
FREEWAYS. THEY THINK. IT IS THEIR PERCEPTION. THEIR "SUPPOSED" MANDATE.
Let's say the Govt. tacitly sanctions this.

Going forward...
The TA authorities, amongst themselves, decide to create mock situations wherein
they purposefully break the laws/ rules/ regulations pertaining to road safety.
They do it all over the country in almost a fully inconspicuous manner in front of
the whole populace. Although hiding the ACTUAL fact all the time that they are,
indeed, the TA.

Frankly, in every which way one takes, they ARE NOT SUPPOSED to do this.
NEVER. THIS IS ONE MOST UNIMAGINABLE and IMPRACTICAL IDEA.

Now, who authorizes them ? Is it at all a legal authorization ?
Do people across the country have the right to know that such an authorization
is possible ? at all feasible ?

Someone says - special Presidential authorization ??

Would they, if the masses knew, support or gang up against such an authorization ?

From general masses perspective - is such a "legal authorization" actually
"really legal" ? Or, is this but a means to prey on the gullible masses.

Who are mostly ignoramuses.

Would the American constitution allow for such Govt. sponsored schemes ?
Would the laws of the land and the legal experts allow it ? Why ?

BE YOUR OWN JUDGE !! USE SOME PERCEPTION, WHATEVER YOU HAVE !!

Now...
The intent, motive, motivation of the TA is ONE - catch those who follow suit.
i.e. who-so-ever make the mistake of following the TA in repeating the same/ similar
mistakes/ blunder/ deviations in any manner/ matter big or small.

Which, in the eyes of the gullible masses, is an ostensibly harmless
ACT !! Why ? Because, the TA being so smart as bordering on genius ( IQ > 200 + )
is legally doing it since several years. So, let's all of us also follow suit !

Their perception could be failing them ! NYET !! AT best - they are being FOOLED.

...

LATER ON, THE TA AND THE AUTHORITIES WILL GANG UP AND SAY - YOU MADE A MISTAKE !!

So, effectively, the TA's ruse is to put a GRAFT in people's mind. Sometimes, SEED
some fallacious/ deviant/ contradictory idea/ thought - so that others might
follow suit AND possibly err in repeating the same ?

Actually, this is but tantamount to putting OUT a BAIT. For those NOT in the know.
IGNORAMUSES.

If you are unsuspecting, an ignoramus or have a perception lapse - you take the bait.
So much for GOOD/ GREAT perception ! It helps to be judgmental.

In such a scenario...
I guesstimate that a good number of those people who could have some deficient
understanding of certain things/ facts/ figures ( including laws, rules, regulations )
might land into the trap of TA and the authorities.

Gung ho attitude with the playfully errant TA ?? Solidarity ?? Loyalty ??

How-so-ever...
If they, but choose to demonstrate to the Transport Authority ( TA ) that they can
DO MUCH MUCH BETTER. SEE. YOU ( TA ) DONE IT. SO... WE UP THE ANTE !!
After all - it seems harmless enough.

Here actual knowledge and real perception, across the wide spectrum of the masses,
matters a lot.

Is it possible that - catching the erring/ deviant set of people is THE ACTUAL GAME.
Perhaps, a SUB-SET of the game.

Whilst...
Whole gamut of the GAME ( THE GAME SET ) is left to BUT one's imagination.

The idea NEVER is to catch THOSE ALONE who are or have been "habitual offenders".
Though, that ALSO IS POTENTIALLY the case.

Or, those having some willful intent/ motive/ motivations that implies these
set of people would ANYWAY violate some rules/ laws/ norms even in the ABSENCE
of the game-fully violative plays demonstrated by the so-called "beneficent" shenanigans of
the Transport Authority ( wielding da baton ).

So, is this to be interpreted/ ascertained that...
... the increasing headcount of those ensnared is a metrics by which the ability/
prowess/ effectiveness of the TA is to be determined/ judged/ assessed ??

MUST ASK WORLD DENIZENS ( ESP. THE FOLKS IN THE WESTERN COUNTRIES ) -
WHAT WOULD THEY THINK OF SUCH A GOVT.-SPONSORED SCHEME, WERE IT TO BE IN PLACE IN THEIR COUNTRY ?

MAKES SENSE ?
SUPERB CONCEPT/ IMPLEMENTATION/ ACTUALIZATION/ FINISH !!

IS THIS THE WAY TO GO !! ??

Someone MUST ASK Bruce Schneier @ EFF his humble opinion on this scheme.
I hold him in great esteem.

Never mind - what their Govt. thinks and fashions. Or, whatever their honorable
"so-called" security apparatus thinks is a game-changer rather than a disguised
devious ploy.

NO GOVT. MUST SUPPORT THIS DEVIOUS STRATAGEM. MUST NEVER ALLOW THIS - MY TAKE.
ACTUALLY - IT WILL BE PEOPLE"S TAKE, ACROSS THE WORLD.

I foresee people being very vocal against such ( potentially Govt. sponsored )
malpractices, were these really in effect anywhere in the world.

In any form, format OR scale. In any guise. In any country.

NOTE -> Anything is (c)overtly Govt.-sponsored if there are current or ex-Govt.
personnel, on board. Hardly matters, whether they be in uniform or not.
Or, even if they are but retired personnel.

And, this is potentially a crime if they are veterans in their field.
With, very high level understanding of world view of things.

An extreme blunder...
If the Govt./ the System does NOT try to somehow straighten out a recurring set of
rhetoric emanating from such deviant authorities/ persons.


D)

Let's say, in our country, the Govt. has an open door policy as far as the firearms
is concerned.

Have money. Go buy one, off the shelf. Arms license can be had at the point of
purchase.

Now, let's say some ( cleverly disguised ) Central Govt. Arms Regulatory Authority
were to run rampage across the country.
Violating some of the very same rules/ regulations/ laws pertaining to the firearms.

Hoping that some dimwits/ retards/ ill-informed/ deficient-knowledged/ less-perception-ed,
etc. set of people could follow suit.
Thereby taking the bait, err and be caught in the net. And, they are but done in.

Now, the Arms Regulatory Authority get a haul. A catch. The errant count keeps on adding over !!

What a gimmick !! Masterly ploy, you say ??

Now...
So, is this Govt. sponsored ? Or, some set of powerful people quite well-entrenched in the
Arms Regulatory Authority, going way TOO over-board ?

Or, are these set of people ex- Arms Regulatory Authority ( retired senior personnel ) ?

Can this be allowed ? Who sanctions this ? Why sanction this ?

Must consider THIS case scenario !

INTELLIGENT and PERCEPTIVE PEOPLE MUST RETHINK. MUST REVISIT THIS FOUL STRATAGEM.


E)

Then, there were a set of Forest Rangers who thought that they owned all the forest
cover across the country. Were free to manage the jungle their way.

As part of the Security Apparatus patrolling the forests...
They decided ( not sure they had the right legal authority. Btw, who authorized them ? )
to flout quite a few rules. Underlying idea being that anyone who follows suit they will
catch as potential poachers.

Catch quite a few of them. Or, perhaps a handful of 'potential' poachers.



F) In one "Dehaati" country there was a gargantuan school. Disorderly. Run by elected set of equally "Dehaati" -type school management.

As is wont in any schools...
There were some instances of a few vocal students creating some din and on certain
instances inadvertently disturbing the decorum of the school environs.

Sometimes even innocent students would say/ state something that was
considered inappropriate by the school admin. Though all the students and the
accused student would take it as a casual remark. Quite natural, as one would expect.

Since, the management itself was "dehaati" by nature, thought and deed. So, under the
meek consent of a "dehaati aurat" type Principal the school admin decided to rein in
the students.

Actually, this was the brain-child of a "dehaati aadmi" who could have easily passed off as a blood-sucking dracula.

This guy with an ILL-LEGAL head had some such demonic aides who basically reveled in being inherently monstrous.

This "dehaati aadmi" got few of the vampires on his scheme of things.
Although there were some sane and humane voices that opposed such deceitful blood
sucking scheme - such reprehensible shenanigans.

TO be let loose on unsuspecting souls... who were basically... students... as such.

MUST NOTE THIS.

They created mock situations wherein they flouted the norms, rules and regulations of
the school, in every which way.

Any unsuspecting student who followed suit, out of solidarity was way too silently
singled out and meted with very harsh punishment.

But, the morons in the school admin failed to understand that for 1 student caught
there are potentially 9,999 students who are being exposed to lots of their BS.
Which all they take as korrect 'GYAAN'.

And, possibly could carry off some of these as true, for life.

Basically, infected with deviant and devious thoughts/ ideas.

IS THIS A GOOD STRATEGY ON THE PART OF THE SCHOOL MANAGEMENT TO CURTAIL STUDENT
OPPOSITION/ PROTEST TO HOW THEY ADMINISTER AND RUN THE SCHOOL ?

NO !! NEVER !! MUST NEVER BE !!


G) CRUX OF THE MATTER... or, MATTER OF FACT...

I have been on the sea ( www, the internet ) since quite a while.
Never faced any problem. Never created any for anyone, anywhere. Ever.

So... when I visit a huge ship ( blog ). I have some perception that tells me that this
ship is having elements of a phising ( err... I mean fishing ) trawler in-built in its
mechanism... and... as a potential OR covert objective.

My intuition. Gut-feeling backed by being years on sea tells me.

Or, was it a fishing trawler indeed... in the guise of a huge ship or tanker !! ??

Whilst boarding the ship ( blog )...

Never mind. I always had a feeling of being safe with the Captain of the ship.
Knowing well that as a fellow compatriot he means good. Would never allow me any harm.
Or, to anyone else ever boarding the ship.
We could differ on issues. Quite natural. But, inherently we are guided the same way ?

Is it not true ze Captain ?

I have great respect/ regard for him. His immense knowledge and perception. Even so now.

The Captain started a campaign.
As a loyal follower I chipped in. Or promised that I will.
But then, I thought it is better to placate the Captain.
So, passed on something for his personal consumption. And, not for publication.

As it turns out...
His voluminous knowledge and perception determined that he would publish it !!

DO YOU BELIEVE THIS !!

Whilst I know pretty well that I am being fooled BIG TIME. Made a scapegoat. This Captain cries wolf !!

It is as if I pass on a .22 pellet to him. As is his wont, he puts it in his cannon/ howitzer. Fires
it. And, makes all hue and cry... So, much sound and fury they ALL never heard !! He blames me for it.
Makes scapegoat. All the while rejoicing with his in mates.

Alternately, it can be construed that...
I pass on a harpoon to him ( basically used for killing some bigger fishes ).
And, what !! He uses it... and claims that I torpedoed his ship and destroyed it.

All the while rejoicing with his (in)mates on board as if they had the haul of the
lifetime.

So much... for the perceived implications and perception of ze Captain !! ??

Bottom-line - If I were to assume who this Captain is - there are 100's of
             assumptions I can make. Still be NEVER really sure.

SO... who's this ze Captain ?


H) I am reminded of a certain lore, I chanced on decades back...

Btw, I do not fully recall this one.

In days of yore...
In a certain kingdom down South, there was an unruly kingdom, ruled by an equally
unruly and impertinent King.

Chaos ruled this kingdom and most of the aspects and facets of good rulership were
missing during this King's chaotic rule.

There was a very famous temple in his capital city. Revered and visted by pilgrims
from near and far.

As is the generic rule... as is the King so shall be the masses.

So, it so happened that this famous temple had a governing body that managed the temple
and the trust.

The governing body, taking cue from the mis-rule prevalent in the Kingdom chose to
go pretty much over-board.

i.e. they, too, gradually became overbearing in the matters of temple's day-to-day management.

For example - they chose to insult some randomly selected pilgrims who would come to visit the deity.
On occasions, they would deny admission to select few pilgrims to the temple's premises.
On whims. On fancy. On prejudices.

Sometimes the priests will deny temple entry citing that you look dirty/ are bare-footed/ you been
wearing leather slippers of late/ to females they will randomly single out and accuse of being in
menses based on their looks / to others they will cite that you belong to untouchable category...
So, no entry for ye ALL folks. So on and so forth...

Mostly, it had to do with being unclean, untidy, unhygienic, etc. externally.

All these were minor offenses indulged in by the care-takers. The MAJOR being that on occasions they will
come up in disguise within the temple's premises and sing/ mouth something in such a manner that someone will
feel compelled to join their chorus.
But these lines, inherently, were designed to be contrary to the temple's governing principles.

So, some authorities will come out of nowhere and catch the offending people and dismiss him/ her from the
temple's premises. Deny these folks entry for several years, as punishment.

Being prejudiced on color, class, caste, rich, poor, age, gender lines. They made life hell for some of the
pilgrims. Especially those who came from afar.

These pilgrims had nowhere to go to mouth their grievances. As, the inept King would not bother looking
into such matters.

Now...
There was a learned, wise old Brahmin living not far off from the temple.
He had been consistently noticing the degradation in the temple's management and the mal-practices
indulged in by the the temple management in managing the day to day affairs.

HE thought of giving the temple management a small but important lesson. So, one fine morning, he
went to the temple with a small bag by his side.

While he was entering the temple premises, he was stopped by the chief care-taker priest of the temple.
Who wanted to know what he had inside the bag he carried.

The old Brahmin opened the bag to show some fishes in the bag. This got the chief care-taker priest furious.
He shouted at the old Brahmin to immediately leave the temple for carrying such impure items within the
temple.

The old Brahmin, totally unperturbed replied -
"As long as your saliva, sweat and excreta remain within the body; your body externally is considered pure.
But, once these leave the body they become impure items you/ we all abhor. This is the fact of life.

Now again, when the soul leaves the human body, the dead body is frowned upon, feared and one shrinks
from even touching such a body.

Now, you say that I am impure and so deny me entry to the temple. How's that possible ?
I remain as pure as I was as if you had NEVER seen the fishes lying in the bag with me.
That I am carrying fishes with me and thus impure is your wrongful perception.

Reformat that thinking, believing that you NEVER ever saw the fishes on my person.

As far as the fishes are concerned. Well, they are going to be someone's meal.
So, not really impure, per se.

Again, I have NOT said or sung anything contrary to the temple's or kingdom's guiding principle.
So, better stop ALL THIS BS and ALL THIS NONSENSE ye ALL have been indulging in since the past
several years. WHY must you continue like this ... ??? "
